Reference is made to the address of this Gentleman. I have the honour to bring the following to your attention.
With reference to the Case stated to me by Haffeus & myself by Section 3 of the new Superannuation Act of 1859 - 22 Vict. c. 26, that my right to pension, irrespective from annuation for abolition of Office, is there established, the said Act defining its application to pensions already in the Civil Service but without prejudice to existing rights.
The Act is applicable again See 4 of the same Act. When 41 years of service in the Civil Service Age, was taken from May 1841, I was prevented Active Service Cause Military Services in May 1841, I was, on account of being attached to a Regiment.

Her Majesty's Plenipotentiary in Canton by order by which I became incapacitated from further serving in Military Honors and Promotion which were awarded to my fellow officers.
I have the honour to enclose a letter from the Secretary & Plenipotentiary in China, and also one from the late de Berry Pottinger, Shewing that my Duties were such as would be required from a Military Commander.
Copies of both of these letters are attached & have been sent to the Colonial Office Despatch No. 919 20. Aug.
The reply received from the Chief Superintendent of Trade was to refer you to the Colonial Office.
I am directed by the Chief Superintendent to request you to reconsider your decision.
